Someone asked me recently when is the best time to trademark your business name or logo. The simple answer: As soon as possible! Really, in general, the sooner the better for filing a trademark for your business name or logo. I discussed in a previous video that you have some trademark rights under common law even if you never register it with the U.S. Patent and Trademark Office (USPTO). But, having a registered trademark is infinitely better and it makes your trademark rights a lot stronger. So, even though you might have a common law trademark in something, its always better to actually register the trademark if you can. To register a trademark, you do have to be actively using whatever the trademark is in commerce. So, if your business is already established, i.e., you have a website or marketing materials using your business name or logo that you are trying to trademark, then you are actively using it in commerce and that will work in your favor when you try to get it registered. If you’re not quite there yet, for example, maybe all you have so far is a great logo, you can still file an application for the trademark. However it is an “intent to use” application… and it is exactly what it sounds like. It means that you are intending to use whatever the trademark is. So, that will buy you some time in being able to actively use that trademark in commerce, but still getting that protection if your trademark is ultimately registered. So, even if your business is not actively started yet, you can, in most cases, still file that intent to use application to get a head start on that trademark registration. So, simply put, the sooner you can file a trademark application, the better off you are. It basically gets you first in line in priority of using that trademark, assuming no one else has already used it. And if you are still getting your business started, you can file that intent to use application in order to get a little extra time for you to start using it actively in commerce. TRADEMARKING A NAME - WHEN SHOULD YOU FILE FOR TRADEMARK REGISTRATION? One of the most common questions we get asked is when you should trademark your brand name or logo. The simple answer is that you should do it as soon as possible. However, this is not always practical for a start up business. In today's video, we explore when you should trademark your brand name or log, and a basic overview of the process. How to trademark a name or business name #trademark - https://www.freischem.eu - Subscribe https://www.youtube.com/subscription_center?add_user=rolfclaessen #rolfclaessen Keywords: How to trademark a name, trademark a name, Rolf Claessen, trademark a business name, Marke, Trademarks, Patent Attorney, Intellectual Property, Trademark, Howto, Tutorial, tradenark, how to protect a brand, brand protection, trademark attorney, how to trademark a business name, Geistiges Eigentum, how to trademark your name, how to trademark a name and logo, trademark your name, trademark (legal subject), trademark registration, how to trademark, wipo, trade name, intellectual property (literature subject), how to trademark a word, how to trademark a band name Often people ask me how to trademark a name. Names, such as product names or company names are typically protected with trademarks. My first advice is to ask a patent attorney or an attorney experienced in trademarks to help you with protecting your name as a trademark. But if you want to get a glimpse of what is needed to do this, then here are the most important things to consider: First of all, you would want to compile all the information you need to protect a name as a trademark. The main three pieces of information would be: a) The sign (e.g. name or logo) b) The goods and services c) The applicant Goods and services are grouped into so called Nice classes, as you will see in the following example: If you want to open a dance studio under the name MARIMBA then this information would be a) Sign: MARIMBA b) Goods and services: 41: Education, entertainment and sports (including e.g. dance clubs, dance instruction, …); 43: Provision of food and drink (e.g. a bar); 25: headwear; clothing; footwear c) Your company name and address or personal name and private address Before protecting a name as a trademark, you find out, whether there are earlier identical or similar trademarks that could cause a conflict. As an example, you do not want to launch a new car under the name of PMW – it would be too similar to BMW. I have a link to a detailed video in the shownotes how to conduct a search for earlier similar trademarks. Once you made sure that there are no conflicting earlier trademarks or company names, then you can actually file your trademark application with the intellectual property office of your country or region. Many trademark offices nowadays offer to file trademarks using a simple web form. You can navigate there and then enter the information that we compiled above. Once submitted, you can a receipt and the office will then start examining your trademark application. The trademark gets registered, if the office did not find any formal errors or did not object to the trademark application for other reasons such as descriptiveness of the mark. Once your trademark is registered, you can use the trademark e.g. to tell other competitors not to use identical or very similar names for the protected services. Or you can issue licenses to your trademark for other dance studio owners and make money that way. I hope I was able to show you how to protect a name or business name. How to file and register a trademark WITHOUT a lawyer!!!

25:29
http://vondranlegal.com/zip-counsel-affordable-trademark-legal-services/ YES YOU CAN SHARE THIS VIDEO ON YOUR SOCIAL MEDIA NETWORKS. MAKE SURE TO SUBSCRIBE TO OUR POPULAR CHANNEL! DON'T FORGET TO WATCH THIS IMPORTANT VIDEO WHICH TALKS ABOUT HOW TO "SEARCH" BEFORE YOU APPLY FOR A TRADEMARk. https://youtu.be/R7GqsYgOV4s Attorney Steve® does it again, this time with a helpful video for startup companies and individuals looking to register a federal trademark but who may not have the money to hire an intellectual property or trademark lawyer. This video is general legal information only and NOT legal advice or a substitute for legal advice. Trademark registration can be MUCH MORE COMPLEX than highlighted in this video. It is important to always do a thorough trademark search BEFORE applying for a trademark through the USPTO. Once you file, you cannot get your money back. So make sure there is no one else using your trademark before you apply. You can do this by searching the internet. Search for domain registrations that may be similar. Search on Google. You can Thomson Thomson to run a detailed paid search. You should also try to pick "arbitrary and fanciful" names as opposed to suggestive and descriptive terms. In other words "Nike" or "Xerox" are better names than "Sports Shoes Company" or "Copy Paper Inc." Be creative - think out of the box. Also, keep in mind there are many different things you can get a trademark (for goods) or service mark (for services) for. Examples are: 1. Your company logo 2. A slogan you use in your business 3. Nicknames (ex. "Johnny Football") 4. Your business name These are just a few of the common examples. At any rate, this video should help you understand what lawyers do when filing a trademark. This is the same process companies like LegalZoom do. So in short YOU CAN DO IT without a lawyer if you take time to read the screens, and watch some of their helpful videos the USPTO offers. If you need help and are willing to pay a LOW FLAT RATE FEE - we can help you. We can also help with the following: 1. Trademark name searches (we can help you pick a good mark to build your brand on) 2. Registering trademarks and service marks 3. Responding to office action letters (refusals or denials) from the trademark examiner 4. Cease and desist letters 5. Trademark arbitration, mediation, litigation 6. Domain name disputes For more information, call us at (877) 276-5084 or click on the link at the top of this page to go to our corporate homepage. As we like to say - we are The First Name In Legal Services" Hope you enjoyed this video!! Check out our others. Keep in mind there are RISKS associated with filing your own trademark with the USPTO (such as having to respond to an office action letter, or having your trademark denied when a good search would have prevented the filing), but many people are finding that filing a trademark application (for example to start your own clothing line, or a name of a band, or product name) is not as mysterious as people once thought. ATTORNEY STEVE TIP: Make sure you SEARCH your mark BEFORE you buy a domain name, engage in advertising, name your product etc. There is nothing worse than picking a name that some other company already has or which is "confusingly similar" to their name, This means your trademark will not register. This is the biggest risk of filing for your own trademark. Sometimes it is worth the money to just pay trademark counsel to search and file for your corporate trademark. We can do slogans, logos, and company names. _______________ PLEASE SUPPORT US ON PATREON - OUR GOAL IS TO BE THE LEADING PROVIDER OF LEGAL NEWS AND INFORMATION BUT WE THERE IS NO WAY WE CAN DO IT WITHOUT YOUR SUPPORT. How To Trademark a Name and Logo | Trademark In Canada And USA

10:32
If you have a name or a logo you want to protect, BOOK A FREE CALL with our strategy advisors at https://trademarkfactory.com/call 👇 SUBSCRIBE TO TRADEMARK FACTORY YOUTUBE CHANNEL NOW 👇https://www.youtube.com/trademarkfactory?sub_confirmation=1 How To Trademark a Name and Logo Secure Your Brand with Trademark Factory® Risk-Free, Guaranteed. https://www.trademarkfactory.com Number 1: Decide WHAT you want to trademark. Would it be your name, your logo, both as a single trademark or both as two separate trademarks. Number 2: Find out if you CAN trademark your brand. You need to know if the brand you picked is even trademarkable. And it means a lot more than simply checking if someone had trademarked the same brand before. Number 3: Decide WHO will own the trademark. Is it you personally? Your company? It can be either, but you need to make sure your decision makes sense from business perspective. Number 4: Decide WHERE you want to trademark your brand. It doesn’t matter where you are. It doesn’t matter where your company is incorporated. What matters is, where do most of your customers come from now or will in the near future. You need to look at your most important markets and trademark your brand there. Number 5: Decide WHEN you want to trademark your brand. You should trademark your brand in your home country as soon as humanly possible. It is often too late but never too early to protect your brand. A great deal of very successful brands were trademarked BEFORE launch. That’s when it’s the easiest to protect your brand—as long as it’s trademarkable. Number 6: Decide WHICH products and services your trademark application would cover. Trademarks don’t give you a monopoly over your name, logo, or tagline themselves. Trademarks give you a monopoly over the mental link between your brand AND the products and services you have listed in your trademark application. For example, Apple doesn’t own the word “Apple.” They own the word “Apple” in connection with computers, phones, software and stuff like that. But it doesn’t mean they can stop someone from calling their excavators “Apple”. Number 7: Decide HOW you will be filing your trademark application. Basically, there are 4 ways to do it. You can do it yourself. The danger is that most business owners, however smart and experienced they are as business owners, don’t know enough specifics about trademark laws to go through the whole process successfully. In case you don’t know, it takes on average 14 months to register a trademark in the United States and 18 months on average to register a trademark in Canada. During these long months, you would be communicating with the Trademarks Office. And if you don’t know what you’re doing, you will probably end up with nothing. The second option is to use online filing websites, which basically have developed software that makes it easier for you to understand what should go where into your trademark application. The problem with this option is that they are not representing you. The third option is to use a traditional law firm. The problem with this option is unpredictability. And finally, the forth option, you’re welcome to file your trademarks through Trademark Factory. Not only will we conduct a comprehensive trademark search to tell you exactly whether your brand is trademarkable FOR FREE, we will also offer you our most popular package All-Inclusive. It’s basically one flat fee for our services that covers everything from start to finish. You will never see another invoice from us. And for most trademarks we file, we will actually also offer a 100% money-back guarantee. Which means that if after spending as much time as necessary trying to come up with a winning argument, if we then lose, you will get all your money back. We’re the only firm in the world that does this. And if you have a brand you want to protect, fill out the form at trademarkfactory.com—and we’ll get the process started. Does my trademark need to match my company name? | Trademark Factory® FAQ

02:27
Does My Trademark Need To Match My Company Name Secure Your Brand with Trademark Factory® Risk-Free, Guaranteed. https://www.trademarkfactory.com The answer is no. Those two things are completely separate. You can file your trademark in your personal name or you can file your trademark in your corporate name. The corporate name doesn't have to match the trademark. One company can own and as many trademarks as it wants. And the best example is Procter & Gamble. They own more trademarks than any other company in the world. So they are not creating a separate company for every new trademark they come up with. So you don't need to wait to register the company with the same name to file for the trademark. As soon as you come up with your brand and you know that your brand is worth trademarking—trademark it and then you can figure out how to call the company. I'll just give you my personal example. Trademark Factory® initially was a trademark owned by my firm Mincov Law Corporation. But then, when I stopped being a lawyer, I renamed the company. Now it’s Trademark Factory International Inc.. The trademark stayed the same, the owner is the same, it's just a different name. So it doesn't really matter. ----------------------------------- Trademark Factory® resources: ★ Website: https://trademarkfactory.com ★ ☆ YouTube Channel: https://youtube.com/trademarkfactory.com ☆ ★ Facebook Page: https://facebook.com/thetrademarkfactory ★ ☆ Twitter: https://twitter.com/realTMfactory ☆ ★ Kick-Ass Brands Show: http://kickassbrandsshow.com ★ ☆ Kick-Ass Brands Facebook Group: https://www.facebook.com/groups/kickassbrands ☆

If someone else is using a name/word/phrase, can I use it too? Depends if it's ™ or ®...

04:04
NOTE: I'm not a lawyer so if you're making a serious decision about your business, don't depend on this video or piece of advice as the end-all-be-all. Get your own legal counsel if needed. "If someone else is already using a word/phrase in the name of their business or product, and I really like it, am I allowed to use it in my business too?" In many cases, yes. If they haven't trademarked it, you can use it. If it's a friend or colleague, it would be good to talk with them about it first, of course. How do you know if someone has trademarked a word or phrase? ® and ™ are different. The ® symbol means it's officially registered with the US government as a trademark. The business has gone through the legal paperwork and paid the fees for an official registered mark. If you use that same word/phrase for your business it would be illegal. However, ™ is only an intention. Anyone can put ™ next to any word/phrase without having to file any legal paperwork. ™ means "I'm thinking about trademarking this word/phrase... so you might want to use another word/phrase, because if I officially trademark this word/phrase in the future, you might be wasting all of your brand-building effort on this word/phrase, because it'll be legally mine at that point." From what I've seen, however, many people who use the ™ symbol never go through with officially registering their trademark... In other words, if you really like a name/phrase some business is already using, even with a ™ symbol you can still use it temporarily for your own business. Just be flexible about changing it in the future. My example: years ago someone suggested that what I do is help people with their “true livelihood”. I liked that term a lot, and started using it. Later, when I tried getting the domain name, I discovered someone else had been using that term for years, but never officially trademarked it. So I’ve been using it just fine for the last 4 years, and it’s been no problem at all. This has been true with several phrases I’ve used, such as Authentic Marketing. If you want to use a term, just google it. Make sure there’s no ® symbol. NOTE: I'm not a lawyer so if you're making a serious decision about your business, don't depend on this video or piece of advice as the end-all-be-all. Get your own legal counsel if needed.

Do I Need To Register My Business Name

06:36
In this tutorial I answer the question: do I need to register my business name? For more tutorials, try my business apps: http://www.problemio.com In this tutorial I answer the question of whether a person needs to register a business name before starting a business. There are two ways to answer this question. You can register your business with the state, or you can register your business name or logo with a trademark. In the video I explain both because the posted question is somewhat ambiguous. If you are wondering whether you should register your business name to get limited liability protection, then you aren't required to register your business name by law, but to register your business name with the Secretary of State office of your state is a good-practice thing to do. Of course, you should consult an attorney before you register your business name anywhere so that they can explain to you the legal and tax implications. The other case when people ask me: do I need to register my business name occurs when people are considering getting a trademark to protect their business name. You are not required to get a trademark for your business name, but it is often a good idea. If I Register My Trademark, Does It Mean No One Can Use It? | Trademark Factory® FAQ

05:03
If I Register My Trademark, Does It Mean No One Can Use It? Secure Your Brand with Trademark Factory® Risk-Free, Guaranteed. https://www.trademarkfactory.com So the general answer to that is yes but there are four exceptions and each of them would cover one word: Can't use my trademark. Can't really means one thing. Would it be legal or would it be not legal? There are people - surprise, surprise! who would do things that are illegal. So just because it's illegal for them to use your trademark doesn't mean that they won't do it. What it means is that if they do it, you would have legal recourse to go after them. So just because you registered your trademark doesn't mean that automatically everybody else would never even consider breaking the law and infringing on your mark. Second word: use. What does use actually mean? So, use has a very specific meaning in the trademark world and it means offering your product or service under that brand to the public or for services it's also advertising that brand. So simply mentioning the name of your startup in a news post or a Facebook post or a Twitter post does not constitute use for trademark purposes. So again, just because you trademarked your brand doesn't mean that you can now silence everybody into never mentioning it as part of their conversation. As long as they are not trying to sell your product or a competing product under your brand, that's not used. The third word is mine. What is your trademark, really? And this boils down to the products and services under which you trademark your brand. You may remember one of the previous videos where I said that trademarks don't give you a monopoly over words, images, or phrases themselves. What a trademark gives you is a monopoly over the mental link between those words, images, and phrases and specific products and services that you use your trademark for. So if you have a business and you, let's say, are a software company and you come up with a brilliant name for it, it doesn't mean that somebody who sells bananas can't use the same name. So they're not using your trademark because your trademark only covers a particular set of industries that you have in your trademark application, maybe a few related ones, but it doesn't cover everything. And finally, the fourth word is a trademark. So, your trademark is national, so if you only have your Canadian trademark, your Canadian trademark stops in Canada. So somebody who is using the same brand in France is not using your trademark. Your trademark does not exist in France. So, does registering my trademark make it easier for me to stop my competitors from using my brand for advertising their stuff? And the simple answer to this question is, of course, yes. But take through the prism of Can’t Use My Trademark, the four exceptions. #Trademark #Registration #TrademarkFactory ----------------------------------- Trademark Factory® resources: ★ Website: https://trademarkfactory.com ★ ☆ YouTube Channel: https://youtube.com/trademarkfactory.com ☆ ★ Facebook Page: https://facebook.com/thetrademarkfactory ★ ☆ Twitter: https://twitter.com/realTMfactory ☆ ★ Kick-Ass Brands Show: http://kickassbrandsshow.com ★ ☆ Kick-Ass Brands Facebook Group: https://www.facebook.com/groups/kickassbrands ☆

Most business owners are under the impression that they can protect their company's reputation, goodwill, products and services by registering their business or company name with ASIC. The only failsafe way to protect your business name from infringement, however, is to register it as a trademark. This video show the difference between a registered business name and a registered trademark. What is a Business Name? Your business name is the name under which you operate your business. Do not confuse your business name with a trademark. You must apply separately to register your business name and successfully undergo a trademark examination by IP Australia before you can obtain trademark protection. The Benefits of Registered Trademarks A trademark can be a word, phrase, symbol, graphic, shape, sound, or smell, or any other distinctive mark that identifies a source of goods or services manufactured, provided, or advertised by a trader. A trademark serves as a badge of origin for products and services. When you trademark a business name, you gain stronger protection of your trade name, trademarks, logos, and your business's goodwill. A registered trademark grants you the exclusive right to the use of that mark, along with the power to prosecute infringing parties. Registering your business name as a trademark not only benefits you as the owner, but it also benefits your consumer market. Trademark ownership also grants you protection against infringement from other parties, including protecting from counterfeiting and passing off. You need only provide evidence of your ownership to take legal action against potentially infringing parties. Is Your Business Name Registrable? Your business name and other intellectual property must distinguish your goods and services from those provided by your competition. For your business name to be registrable, it cannot be similar or identical to another trader who provides similar goods or services to you. Your mark must be truly unique to be eligible for registration. Let us register your business trademark today! How to Get a Trademark for My Logo and Brand Name - Entertainment Law Asked & Answered

05:15
A web visitor wrote in: I have created a Logo with a generic phrase for my apparel company, with a design that indicates just what it means by utilizing a letter as part of the graphic. I would like to use this both nationally and internationally as soon as make sure that I secure the trademark for it how do I go about getting the trademark registered? He goes on to ask me to Suggest the proper or best business structure to maximize profit, minimize liability and protect my assets from taxes and judgements, so he will have the most latitude to operate his business on a global scale with minimal risks. Well, this is a great, and complex question. First off, a trademark is... A distinctive word, symbol, or phrase that's affixed to goods or services in commerce as an indicator to identify their source or origin. Trademarks are Brands... Just like the brands that used to be burned into the hides of cattle to identify the ranch they came from. You acquire trademark rights by actually using the mark in interstate commerce to sell goods or services. Trademarks protect only against others using the same or confusingly similar marks in the same class of goods and services. So, if you have a trademark for a particular brand of medical device, you probably can't prevent the same mark being used for a line of shoes, or as a title for a TV series... Now, because we are talking about what the person describes as a "generic phrase" it's probably not distinctive enough for trademark registration just by itself. But, the inclusion of a stylized letter and distinctive design might make it registrable as a logo design. Now, the process isn't that hard. Nowadays, we do the applications online, and it's a step by step process. But it can be tricky because how you complete the application can have a big impact on whether or not the application gets approved. You might, for example, need to disclaim certain aspects of the mark, like the generic phrase in our readers’ situation. Or, selecting the right kinds of specimens of use to ensure maximum coverage and protection. It's also possible to go too narrow or too broad in the description of goods and services and risk being underwrote the, or possibly losing your mark later if you're discovers to have overstated the scope of your use of the mark. The best way to ensure your trademark gets registered, and you get all the benefits and protections, is to have a lawyer prepare the application for you. Those of us who do this a lot have learned about all the problem areas, and have a handle on the best practices to get things done right. My experience is that folks who do it themselves have their applications rejected more often, and then, unfortunately have to hire me to fix the problems they encounter. That usually costs as much or more than they'd have paid me to do the registration in the first place. Your trademarks, your brands, may someday be the most valuable assets your business owns. So, it makes sense to invest a little bit now to protect them, when doing so is relatively easy. Rather than paying a lot to clean up messes later. --- So, what's the proper or best business structure to maximize profit, minimize liability and protect assets from taxes and judgements? Well, there are several kinds of legal structures that can help on this. The most common, and most established is the corporation, which provides insulation from liability for shareholders. But corporations come with some administrative hoops you need to jump through, and they have to pay taxes separately, so income can sometimes be taxed twice. Sub chapter S corporations are for small, closely held companies, like family owned enterprises, and similar, where there are a small handful of shareholders... These corporations can be taxed like a partnership, where profits pass through directly to shareholders, so that double taxation doesn't happen. But these corporations also have the administrative hoops I mentioned before. An LLC offers most of the advantages of corporations, but can be taxed as a pass through entity, and don't have the same administrative hoops, but they’re not as well established forms of entities, and can have other tricky aspects. The bottom line is, I just can't give a general answer here. Every business is different, so you need to consult with an experienced business attorney (like me) who can help evaluate the situation and advise you accordingly. Getting this stuff right is important, and it's always best to handle these things as you're starting up, so you don't wind up having to backtrack, or unwind transactions later on when your structure changes. Invest a bit now, so you don't overspend on fixes later. And that’s going to do it for this video… If you have a question you'd like to see here on Asked and Answered, just visit http://firemark.com/questions and let me know. See you next time!

Can I Trademark A Name Someone Else Is Using?

03:51
Can I try to trademark a name someone else is using but hasn't trademarked? Debbie LaChusa, founder of The Business Stylist Marketing Academy answers this question http://www.tbsmarketingacademy.com What do you do if you've come up with a great brand name, and you discover others are using it, BUT no one has trademarked it? Should you still use it? Will you be able to trademark it? This is a question I recently got from a coach. She had noticed a few people were using the name she wanted to trademark but none of them had trademarked the name. She wondered if she could still trademark it and whether or not if she did, if the others would be able to continue using the name. Bottomline, she wanted to know if it would be a bad idea for her to continue using and trying to protect the brand name. Watch the video or listen to the podcast to hear my answer. 3 Terms You MUST know for Registering your Trademark

03:50
Here is the link to check your brand name availability in less than one minute - http://vakilsearch.com/trademark-search If you are applying for a trademark registration in India, then you must be aware of these terms, which your Trademark Lawyer might use. 1. Word Mark 2. Logo Mark 3. Logo Composite Mark WORD MARK: A word mark is a Trademark applied for a word. Typically, this word is your Brand Name. For example, AIRTEL is a brand name, McDONALDS is a brand name. LOGO MARK: A logo mark is a Trademark applied for a logo. A symbol or image through which customers identify your business is called a Logo and that can be protected through a Trademark. LOGO COMPOSITE MARK: A logo composite mark is a trademark applied for a Logo. It is different from the Logo Mark in the way that you can read the name of the brand from a Logo Composite Mark (but not from a logo mark). For example, you can read the brand names from the logos of Coca Cola, Nokia, Samsung, and Airtel. Such logos must be trademarked as a Logo Composite Mark. Would you like to avoid such devastating scenarios that can hurt your businesses image? which can result in all the hard work you put in building brand name (image) of the business going waste !!! Then you need to seriously consider protecting your business name, identity, brand, logo, image etc. This is achieved by registering Trademark for your business. If properly used and promoted, a Trademark becomes the most valuable asset of a business. hence it is important to consider Trademark registration India. The procedure for registering trademark in India Step 1: trademark search (time: about 4 hours) Cost: Rs 0 to Rs. 500 This search is to check whether your business name or logo is similar to other already registered trademarks. Generally trademark agent or attorney conducts this search with the Trademark Office to check if there are any similar trademarks already registered under that particular class. There are two kinds of search: online and offline. It is recommended that you get both the searches done. Once found to be unique you can proceed to the next step: Step 2: create trademark application (time required: 2-3 days) Based on the results of the search conducted, the trademark attorney will draft trademark application, provided that your business name / logo found to be unique. If someone already has the same or similar trademark, you need to change yours. Or if you are of opinion that the trademark is rightfully yours and you are using it since long time even before other party trademark registration. You can start using ™ symbol as soon as you file the form of trademark application. Step 3: trademark registration (time 18 to 24 months) Cost: Government fees is Rs. 4,500/- in case of Individual/ Startup/ Small Enterprise (it would be 9,000/- in all other cases) and trademark attorney professional fees is Rs. 3500/- per application per class. The Trade marks office will first check your application to see if it's already been taken. If it has, a trademark objection will be raised. If it has no objection, it makes an advertisement in the Trade Marks Journal. If there is no opposition from other businesses in the next four months, your trademark is registered around six months later. Risks of Filing your own Trademark with the USPTO

05:14
Question of the Day: What are the Risks of Filing a Trademark Yourself? You don’t need a lawyer to filing your trademark with the U.S. Patent and Trademark Office (USPTO), but it’s not recommended because you waste time and money in the process. If you can’t afford an attorney to shepherd your application through the whole process, it’s a good idea to meet with an attorney in advance to make sure you have a trademarkable brand and that you’ve compiled all the necessary information. If you receive an Office Action from the Examining Attorney, you should call an attorney for a consultation prior to submitting a response. Here is more information about the process to file a trademark: http://bit.ly/1g2yhaA. Under the best circumstances, it will take at least 8 months to get a trademark through the USPTO filing process. A lot of people get trademark and copyright confused. Here’s the difference: http://bit.ly/1OhJref. Ruth Carter is an attorney at Venjuris Law Firm in Phoenix, Arizona. She is also a professional speaker, blogger, and author through Carter Law Firm. What Is The Difference Between Patent, Trademark and Copyright

04:38
If you are starting a business, take my course on starting a business: https://www.udemy.com/how-to-start-a-business-go-from-business-idea-to-a-business/?couponCode=ten_youtube Here is a full list of my business books: http://www.amazon.com/Alex-Genadinik/e/B00I114WEU For more business help like this tutorial on the difference between a patent, trademark and copyright, try my business apps: http://www.problemio.com In this tutorial I explain the difference between a patent, trademark and a copyright. Patents, trademarks and copyright are actually very different kinds of things from one another. What unites them is that they help entrepreneurs and business owners protect their intellectual property. But how patents, trademarks and a copyright function, and the role they play has very little overlap. The reason it is important to do a tutorial explaining the difference between a patent, trademark and a copyright is that patents, trademarks and a copyrights often get confused one for another by first-time entrepreneurs, and the explanation of the differences between these legal tools has to happen time and time again. A patent is used to protect an invention. The invention has to already be created. So it can't be a business idea for an invention. The patent must be used to protect the actual invention, or something in the invention. There are provisional patents that allow you to get started patenting your invention earlier. But overall, patents are meant to protect actual inventions. Trademarks are meant to protect logos, business names, and business slogans. Trademarks are useful when you want to make sure that no other company can use your business name or brand name, or logo, or any slogan. It is also useful to check whether your business encroaches on any existing trademarks before using potential names for your business because if you do encroach on an existing trademark, the company who owns that trademark has the right to make you change your name. And a copyright is meant to protect a body of writing such as a book. A copyright is also meant to protect something you write that may be found online. To get help with your patents or trademarks, please contact a law professional who specializes in intellectual property law. I created mobile apps that help you with your business. Difference Between Copyright vs. Trademark vs. Patent

03:40
What's the Difference between Copyright vs. Trademark vs. Patent? At a fundamental level, Copyright protects your original creative works such as books, movies, songs, paintings, photographs, and web content. As the owner of a copyright, you can control how your work is reproduced, distributed and presented publicly, and you can sue infringers in court. An idea itself cannot be copyrighted. A work must be in a fixed, tangible form to be protected. Copyright registration provides legal evidence and public notice of ownership, and by allowing the copyright owner to bring suit in court if there’s any infringement. Authors, artists, and other creative professionals typically seek copyright protection. On the other hand, Trademark protects the names, symbols or slogans for products or services that you sell. In other words, a trademark lets the consumer tell the difference between one company's product or service from another's. Trademarks include brand names such as "Coca-Cola" and images such as Nike's famous "swoosh." As the owner of a trademark, you can sue for trademark infringement and prevent someone else from using your name, symbol, or slogan. A trademark registration can potentially have an unlimited term, but has be renewed every ten years. The owner can renew the trademark registration as long as the mark remains in continued use. For more information about how to file your own trademark, feel free to enroll in my course, “How to Trademark on Your Own.” Business and product owners typically seek trademark protection. And lastly, patent protects your inventions and designs. There’s two kinds of patent protection — utility patent and design patent. Utility patent protects your inventions with a new or improved function, such as machines, processes, or chemical compositions. On the other hand, design patent protects any new, original, and ornamental design for an article of manufacture that does not affect the article's function. Filing a utility or design patent gives you the exclusive right to prevent others from making, using, selling, or importing the protected invention. If you do not file a patent, then the law doesn’t offer any protection for your invention. A utility patent protects an invention for 20 years and it cannot be renewed. On the other hand, a design patent protects a design for 14 years and it also cannot be renewed. Inventors and designers typically need patent protection. 💸 GET YOUR [FREE] BUSINESS CHEATSHEET: https://mollaeilaw.com/start-business 🔎 RESOURCES MENTIONED Get my course "Easily Register a Trademark (On Your Own) here: https://www.udemy.com/trademark/?couponCode=YOUTUBE15 Get my course "Copyright Protection for Entrepreneurs (Protect Your Work) here: https://www.udemy.com/copyright/?couponCode=YOUTUBEPROMO15 🔔 SUBSCRIBE FOR MORE VIDEOS LIKE THIS https://mollaeilaw.com/youtube ▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬ 🧔 ABOUT SAM MOLLAEI, ESQ. Mythbusters - I Registered My Business Name, Isn’t That a Trademark?

I Registered My Business Name, Isn’t That a Trademark? Patrola Law Corporation http://patrolalaw.com Hey guys, there's a misconception that I want to clear up. Often times, when clients are getting a company incorporated, they believe that getting that company name reservation is the same as trademark protection. It's not, it's not even close. Getting a company name reserved only means your corporate entity has rights to that name and perhaps you can keep other companies from being incorporated with the same name. However, it does not protect your brand. A company that has a different name, could even be a numbered company, can go ahead and use the same brand as yours - on their website, on their storefront. And there's no a whole lot you can do about it, particularly if you have no market exposure where that other company is doing business. If you want to protect your brand, you most likely will need to move forward with a trademark application. If you have any questions, feel free to give us a call back. We'd be happy to help. How to Register - Trademark & Brand

14:34
My shop on Amazon https://www.amazon.in/shop/ecomsellertips In this video i have explained the complete process of trademark or brand registration. Brand registration is important for sellers who are selling unbranded, private label products. Branding is very important as it protects your business interest and gives you an identity. You can protect your brand in whatever categories you are dealing shoes apparel jewellery mobile accessories or any other product categories . they are different class in IP India where all the product categories fall. currently 45 classes are there your product will fall. In one of those classes once you get your Trademark registered in particular class you can use it and ip India will restrict any other seller or manufacturer from using that brand or -trademark. alternatively you can also get your -trademark of brand name registered in every 45 class . so that you are -trademark of brand name will be exclusive to you and nobody can use it in any other product category without -trademark also you can sell your product on different web portals like Amazon Flipkart Ebay Snapdeal ShopClues but in that case anyone can use your listing to map their products.
