The Brussels Regime instruments are a set of similar legal instruments, based on which jurisdiction (and recognition) is determined. The instruments are the Brussels I Regulations (44/2001 and 1215/2012), Lugano Conventions (1998, 2007) and the Brussels Convention (1968). The conventions together cover the European Union, Iceland, Norway, Switzerland, Aruba and all French territories. A legal basis for cross-border injunctions may amongst others be found in Article 6(1) (most instruments) or Article 8(1) (EU regulation 1215/2012), providing that "a person domiciled in a Member State to also be sued where he is one of a number of defendants, in the courts for the place where any one of them is domiciled, provided the claims are so closely connected that it is expedient to hear and determine them together to avoid the risk of irreconcilable judgments resulting from separate proceedings". For a period in the late-1990s, national courts issued cross-border injunctions covering all Brussels regime jurisdictions, but this has been limited by the European Court of Justice (ECJ). In two cases in July 2006, interpreting Articles 6(1) and 16(4) of the Brussels Convention, the ECJ held that European patents are national rights that must be enforced nationally, that it was "unavoidable" that infringements of the same European patent have to be litigated in each relevant national court, even if the lawsuit is against the same group of companies, and that cross-border injunctions are not available. In particular, the court set forth in grounds 41 of case C-539/03 that "Article 6(1) of the Brussels Convention ... does not apply in European patent infringement proceedings involving a number of companies established in various Contracting States in respect of acts committed in one or more of those States even where those companies, which belong to the same group, may have acted in an identical or similar manner in accordance with a common policy elaborated by one of them". In other words, there will be no close connection between claims as required by Article 6.1 if two closely connected companies domiciled in different Contracting States act (infringe) in the same manner. Also in 2006, the ECJ decided on case C-04/03 (GAT/LUK). The court ruled that "Article 16(4) of the Convention … is to be interpreted as meaning that the rule of exclusive jurisdiction laid down therein concerns all proceedings relating to the registration or validity of a patent, irrespective of whether the issue is raised by way of an action or a plea in objection". As of 2015, Article 16(4) of the Convention corresponds to Article 24(4) of EU regulation 1215/2012. The ruling in case C-04/03 confirms that the courts of each Contracting State have exclusive jurisdiction on validity of patents registered for the territory of that State. Exclusive jurisdiction under Article 22(4) applies irrespective of whether a patent proprietor is sued for revocation or whether an alleged infringer asserts invalidity in inter partes proceedings. In 2012, nearly six years after its rulings on cases C-04/03 and C-539/03, the ECJ decided on case C-616/10 (Solvay/Honeywell). The court held that "Article 22(4) of Regulation No 44/2001 must be interpreted as not precluding, in circumstances such as those at issue in the main proceedings, the application of Article 31 of that regulation". Since Article 31 is about provisional measures, a court may issue a cross-border injunction where an action aims for such measures. The ruling on case C-539/03 allows for a court to issue cross-border injunctions as provisional measures where companies domiciled in different Contracting States infringe in the same Contracting State.

Contracts’ has been -- since 1968 -- the stalwart voice of authority in what is widely acknowledged as an exciting, multi-faceted and undeniably complex area of shipping law. This highly regarded work has now come out in a new sixth edition as part of “British Shipping Laws”, and whilst retaining the same logical structure of the previous edition of 2012, it contains a great deal of new material reflecting the substantial changes that have taken place in this area over the last turbulent five years. This, as the author Professor Filippo Lorenzon points out, is indeed an exciting area of commercial law, noting for example, that ‘a contract of sale on CIF (cost, insurance and freight) terms (has) for the last century, constituted the most important instrument of overseas trade.’ Under a CIF arrangement, the price the buyer has to pay must include the cost of the goods, plus their insurance against risk, plus the cost of freight which carries them to their port of destination. ‘It follows’, says the author, ‘that the performance of a CIF sale has both a physical and documentary aspect which creates legal and practical difficulties.’ Fortunately for the bemused practitioner advising on such difficulties, the complexities of CIF and FOB are extensively and intensively elucidated and discussed throughout the eight-hundred or so pages of this book, which provides any number of citations from case law, together with the views of other commentators. As for the F.O.B. term, its definition is referred to as flexible and therefore adaptable to a variety of practices and circumstances. As the shape-shifting nature of such a term can cause confusion (especially if and when it overlaps with the terms of a CIF contract), it is useful that Part III of the book covers it in detail, supported by numerous references to cases. We found it useful that Part I of the book discusses the basics of CIF and FOB prior to dealing with the specifics, including the issues inherent in non-performance, for example, frustration and force majeure and remedies. The book concludes with a discussion of such matters as jurisdiction and conflict of laws. Notably the final 200 pages of the book contain fourteen appendices no less, which range from the 1889 Factors Act to the Carriage of Goods by Sea Act of 1992, to Regulation (EU) No.1215/2012 Recast. With its detailed table of contents, twenty-page index, copious footnoting, numbered paragraphs throughout and fifty pages of tables of cases, statutes and statutory instruments, this long-established and authoritative work of reference is, thankfully, easy to navigate. Commercial lawyers and certainly shipping lawyers, as well as academics, will welcome this new up-to-date edition of Sassoon as an essential acquisition for the well-stocked shipping law library. The publication date is cited as at 2017.

If this does not sound like a simple question, it isn’t -- as any practitioner in international private law could tell you -- and neither are the myriad related problems which emanate from it, any or all of which require detailed analysis and informed and authoritative commentary, which this book amply provides. Published by Informa Law from Routledge, this is the sixth edition of a long established and highly regarded work which is regarded as the foremost authority on how to enforce civil judgement specifically in the European legal landscape. Its author, Professor Adrian Briggs is the Sir Richard Gozney Fellow and Tutor at St Edmund Hall at the University of Oxford and also practices from chambers in the Temple. The focus of the book, says Briggs, is jurisdiction and ‘the enforcement of judgments in civil and commercial matters in general’. This means, he adds, that ‘the main focus of this book is on the Brussels I Regulation,’ a European instrument designated as ‘recast’ in its most recent form as Regulation 1215/2012. Adopted in 2012, the Regulation was brought into effect, after many delays, on 10 January 2015. The end result is considered by many to be rather a flawed instrument, which is why it is anticipated that the recast Regulation will be looked at again in another ten years, by which time, as Briggs hopes, there will be another edition of this book. In the meantime, the value of this new sixth edition is that it explains matters which have become unnecessarily complex. Most practitioners will remember how complicated enforcement of overseas judgements can be when they recall their days as law students, dazed, confused and bemused by the intricate aspects of a field of legal endeavour which involves multiple jurisdictions within the European Union, as well as internationally. Fortunately, this impressive work of scholarship also dwells on the practical aspects of this area of law, such as deciding where to sue… and whether the resulting judgment would be capable of being enforced elsewhere. Procedures for serving process and for objecting to jurisdiction are also dealt with --and here we cite only a few examples of the helpful insights contained in this volume, including a separate chapter on arbitration. Despite the complexity of the subject, or indeed because of it, the book has been logically organized and easy to use. There is a minutely detailed table of contents of at least twenty-four pages which makes it a lot easier to find what you’re looking for, together with four appendices and useful index at the back. There are over sixty pages of tables of cases, statutes, statutory instruments, civil procedure rules and European legislation. This book is therefore to be welcomed as a definitive work on how civil judgments are enforced internationally when you are talking about -- and involved with -- inter-jurisdictional matters. Every practitioner, particularly those specialising in international private law, should have a copy. The publication date is cited as at 10 January 2015, and that is the date when the recast Regulation, now re-numbered as 1215/2015 – and in the words of Briggs, ‘went live.’

The Nature or Natures of Agreements on Choice of Court and Choice of Law

To judge from judicial decisions over the last 20 years, the English common law version of private international law has come to treat agreements on choice of court as contractual agreements that will be enforced in almost exactly the same way as any other bilateral contractual agreement. This had led the courts to some conclusions, particularly in the context of remedies against breach, which look surprising as features in the landscape of private international law. But this narrow contractual focus, which takes it for granted that agreements on choice of court are promissory terms of a contract, liable to be enforced as such, has blinded lawyers to the possibility of viewing them as (multiple) unilateral notices. But Regulation (EU)1215/2012, otherwise known as the Brussels I Regulation, provides the basis for one alternative understanding of what is involved in making an agreement on choice of court. When it comes to (agreements on) choice of law, the English courts have managed to avoid having to decide whether such terms in a contract are promissory in nature. The idea that they may be non-promissory terms has yet to be worked through; but it may provide a more satisfactory basis for providing answers than the alternative, that they are promissory terms. The aim of the discussion will therefore be to consider the nature or natures of agreements on choice of court and on choice of law.

An appreciation by Phillip Taylor MBE and Elizabeth Taylor of Richmond Green Chambers. A RULING ON OUR LAWS. The rule of law, as Francis Neate explains, has emerged prominently into public discussion and although it defies a precise definition, its of special interest to lawyers, and one to which they should perhaps pay more attention, he suggests. As General Editor, Neates 270 page work in 27 chapters is a compilation of academic papers on the rule of law. These papers were delivered primarily at one of several international symposia by a number of distinguished contributors ranging from Lord Bingham and Lord Goldsmith to Valery Zorkin, the first and current Chairman of the Constitutional Court of the Russian Federation. Other contributors include Mary Robinson, the former Irish President and Justice Albie Sachs, anti-apartheid campaigner appointed by Nelson Mandela in 1994 to serve on South Africas Constitutional Court. Just reading their brief biographies in the introductory sections of this volume is an interesting exercise in itself to research our concept of the rule of law. The symposia were convened under the auspices of the International Bar Association (IBA) which has been at the forefront promulgating interest in and insights into, the rule of law worldwide. Basically the rule of law refers to a system of law binding on all -- even kings -- and acts as a restraint on the powers of the mighty. The laws of Moses are a good example. It encompasses two fundamental principles, namely that those in power should not make the laws and all people (including those in power) should be bound by the laws. The Rule of Law, said Aristotle in The Politics is preferable to that of any individual. Since Aristotle -- and Socrates and Plato a century before him -- the quest for justice under the law has been a recurrent one. The epic struggle to establish and apply the principles of the rule of law has taken place over more than two millennia. The struggle, which still continues, has been advanced by certain pivotal events like Magna Carta in 1215, the Putney debates at the end of the English Civil war and the American Revolution, which as Neate says: represented a major turning point in the history of the relationship between government and the governed. Dipping into the content of the book, one discovers any number of interesting gems. For example, check out the chilling reminder of how Hitler circumvented and abused the Rule of Law in Nazi Germany by the simple expedient of the Enabling Act, which was passed without the required two-thirds majority. Communist members, having been arrested, were prevented from voting. Remaining representatives were reminded of the persuasive power of the storm troopers. The Enabling Act, as a device, meant that Hitler could enact legislation without Parliamentary ratification and therefore without any checks on his legislative power, which in these turbulent and unsettling times begins to sound vaguely familiar especially the bit about parliamentarians being arrested. How much legislation has been enacted in the UK during the last decade without parliamentary debate and almost unnoticed by the press or public? One can always dream up excuses for this disquieting situation, the most oft repeated being that debating various measures in parliament is so, well, tedious and time wasting. How easily are hard won liberties eroded in the name of efficiency. With its global and historical perspectives, Neates editorship of The Rule of Law is certainly a riveting read and offers authoritative and fantastically useful background to practitioners, students and casual readers alike who wish to delve further into this fascinating and suddenly very topical subject which we will have another electoral ruling on soon. Adjusting tonearm balance and tracking force on a DUAL 1009 or 1019 turntable

This video shows the basic steps required to set up the tonearm on a DUAL 1000-series turntable. The steps are: 1) Level the turntable platter using a spirit level and an old record 2) If not already fitted, install the cartridge and stylus. 3) Set the tracking force dial to zero 4) Protect the stylus/record from accidental damage by using the stylus guard, if fitted. 5) Insert the counterweight in the rear opening of the tonearm but do not tighten the counterweight clamp screw initially. 6) Un-clip the tonearm from its rest and position the headshell between the rest and the record 7) Move the counterweight on its shaft toward the headshell if the tonearm tube angles up toward the headshell (headshell too high/light), or away from the headshell if the tonearm tube angles down toward the headshell (headshell too low/heavy). 8) When the tonearm tube is more or less parallel to the surface of the record, gently tighten the counterweight clamp screw. 9) To finely balance the tonearm, rotate the counterweight clockwise (viewed from the rear of the turntable) to lower the headshell or counterclockwise to raise the headshell. 10) When the headshell is close to being level, remove the stylus guard and, while making sure you have hold of the finger-lift on the side of the head-shell to stop accidentally dropping the stylus onto the record, position the stylus over the lead-in part of the record (the outer part of the groove). 11) Gently release the finger lift and look to see whether the stylus is close to, but not touching, the record surface. Clearance of around 1/8 inch from the stylus to the record is usually about right, but this will vary with different cartridges. If you need the stylus to move slightly closer to the record, turn the counterweight clockwise just a touch - or counterclockwise if you need to raise the stylus slightly. Caution! Small movements of the counterweight cause big changes in stylus height, so check the stylus constantly and ALWAYS hold the stylus clear of the record (using the finger lift) when adjusting the counterweight!!!. 12) When you are happy with the height of the stylus and see that the tonearm tube is parallel to the surface of the record, replace the tonearm back on its rest and lock it in place. 13) Using the vertical rotary dial on the tonearm pivot assembly, reading from the front of the turntable, adjust until the desired tracking weight (in grams) appears behind the red indicator line. The correct weight will be determined by the make and model of cartridge you are using. For the Shure V15-II used in this video, I set weight to between 1.75 and 2 grams. 14) Other than adjusting the lateral bias (if fitted, e.g. on the DUAL 1019, but not fitted on early 1009 models), you are ready to connect and enjoy your turntable! Here is considered as the birthplace of democracy . Scene 3 So, For the very first time, decisions were made by the people instead of rulers... but sadly, the ancient greeks did not see all people equally. Slaves, women, children and the people who did not have a land weren’t allowed to vote. This is what we call a “flawed” democracy today. Scene 4 After the Greeks lost their power and influence in the first century AD, their early forms of democracy were also fading away until the Magna Carta was signed in 1215, which prevented the King of England to do whatever he wanted and said that even the King had to follow the country’s rules and laws which were written in the constitution. Scene 5 Today, most democracies are indirect or representative which means that you can’t vote for a new law yourself, but you can vote for people who then become law makers and present your interests. But democracy isn’t just about voting; it’s about everything to protect the best interests of the people, no matter what is their race, gender, political opinion, or religion. These interests can be human rights, quality of life, infrastructure and many more. Scene 6 Modern democracies divide powers into three different branches : the legislative (the people who make law), the executive (the people who make sure that you obey the law), and the judiciary (who judge you if you commit a crime). These three are independent and work following the process « checks and balances » which means all the work must be clear and fair. And, very important, the people who have power also must follow the law and not exceed their authority. Scene 7 In addition, a democratic government must work in a way that reflects the wish /feeling/desire and values of the society that it governs—this is also known as the « General Will », which is a concept developed by the famous Swiss philosopher Jean-Jacques Rousseau. Scene 8 One of the problems of democratic voting is that the biggest groups of people always have the most power and that’s why a good democracy also has laws to protect the rights of its smaller and weaker groups. A democracy where the majority chooses to separate, set apart, expel or injure its minority is not a functioning democracy! Scene 9 So, with those mentioned above, what do you think now about democracy? Lawful Rebellion - Its Time To Reassert Our National Sovereignty

By: Rogers Hayes & The British Constitution Group Mirrored By: NAUresistance.org On the 15th June 1215 the Great Charter of Liberties ('magna carta communium libertatum Angliae') was agreed between King John and the rebellious Barons of England. This Charter effectively ratified the supreme constitutional principles of: firstly, that the State exercised governance only with the full consent of those it governed; secondly, the right of the governed to invoke lawful rebellion was conceded formally by the State; and thirdly, that these fundamental rights extended for all time to us all (the 'communa tocius terre'). The Great Charter, codified by us, the people, gave the principles upon which the Resistance may be pursued. Article 61 of the Charter provides for the action of lawful rebellion. It refers to "communa tocius terre" (all the people of the land) - and does so in terms of Article 1 of the document, with specific reference to "all freemen of the realm". This Charter is still Law. It has not been repealed since it is not within the power of Parliament to set aside agreements between the people and the Monarchy. Our present system of government (of Parliament) is the consequence of this ancient and exemplary act of lawful rebellion. Parliament cannot therefore undo or deny to us our Customs and Constitution without committing the ultimate act of treason and betrayal. Not only must The Great Treason be opposed and stopped - it must also be undone. The United Kingdom Government has, over the last one hundred years, conspired to become a treasonous assembly and Parliamentary dictatorship. Parliament has acted with malice towards the English. It makes unlawful Statute for the purpose of giving life to its treason -- and to suppress dissent. The members of this wretched assembly are oath breakers. Parliament has betrayed those English people who have given their lives to defend this sovereign nation. This is The Great Treason. As members of 'a people' -- of the descendents of the first people of this Island -- we have a natural entitlement to self-determination. And, as descendents of those that gave us, a free people, our Constitution and Law, we have also an irrevocable right to declare lawful rebellion against a malevolent and authoritarian State. The State must be answerable to the people or suffer the consequences as a treasonous assembly. The Magna Carta is unambiguously a Charter for the freedom of the people. Clearly it does not provide a warrant for anyone resident here to engage in rebellion (Magna Carta, Article 51). It does not extend to the treasoners (obviously), nor to the treasoners' collaborationists and auxiliaries. The right of self-determination -- of the native entitlement of the people of Britain -- is reflected in Constitutional Law. And not just in Magna Carta. For example, the Act of Settlement 1700 (section 3) states: That after the said limitation [of succession] shall take effect as aforesaid no person born out of the kingdoms of England Scotland or Ireland or the dominions thereunto belonging (although he be made a denizen) (except such as are born of English parents) shall be capable to be of the privy council or a member of either House of Parliament or to enjoy any office or place of trust either civil or military or to have any grant of land tenements or heriditaments from the Crown to himself or to any other or others in trust to him. This is still Law. The objective of the Lawful Rebellion is therefore to end the Great Treason; to bring the treasoners to account; and to undo the harm done to us by those people. Lawful Rebellion has the authority of native entitlement; of precedent set in ancient Constitutional agreement; of Natural Law; and of a powerful moral argument. Lawful Rebellion is an act of lawful resistance against an unlawful and treasonous State. Lawful Rebellion is not a single act... it is a process. It has many facets and comprises the bringing together of people of like-mind who seek to reassert our national sovereignty whether as individuals or in groups under the single and recognised umbrella of 'lawful rebellion' so that a variety of actions may be taken that will eventually lead to the unequivocal recognition of our constitution and the acknowledgement of the reassertion of our national sovereignty - in defiance of those who have worked to destroy it. The arguments against state-run socialised healthcare, including rationing, impersonal care and the lack of medical privacy are well-covered in the context of the Senate healthcare bill. This is the second UKIP MEP to be interviewed by Alex Jones and represents a significant development in the association between the US and UK movements for national sovereignty and respect for the hard-won, constitutionally entrenched, rights of the individual and restraints upon the lawful power of the State; sovereignty resides with the People, any and all legal authority of Government exists by and only "with the consent of the Governed."

They both fall on the same day, 15 June. The Magna Carta was signed in 1215 and the Peasant’s Revolt was in 1381 but both on June 15th. If the Magna Carta had delivered all that we are being told was delivered, then why would Wat Tyler have led the revolution to London demanding equal rights to the barons that had started collecting their own stealth tax, otherwise know as the dreaded Pole Tax, on top of the King’s taxes. Inside sources confirm to Infowars that the elite conference, which will take place from Thursday onwards at the five star Marriott Hotel, will center around how to derail a global political awakening that threatens to hinder Bilderberg's long standing agenda to centralize power into a one world political federation, a goal set to be advanced with the passage of the Transatlantic Trade and Investment Partnership (TTIP), which will undoubtedly be a central topic of discussion at this year's meeting. The TTIP represents an integral component of Bilderberg's attempt to rescue the unipolar world by creating a "world company," initially a free trade area, which would connect the United States with Europe. In Denmark itself, the buzz is centered around Morten Messerschmidt and the Danish People's party, which won 27% of the vote in the Euro elections and doubled its number of MEPs. Although some are wary of Messerschmidt's far right inclinations, his success reflects a general resentment not only in Denmark but across Europe towards immigration and the welfare state, concerns that the EU has only exasperated. Meanwhile in France, Marine Le Pen is carving out a role as the face of a conservative movement that threatens "to break up one united Europe," with her European election win being described as an "earthquake" that has rattled the political heart of Europe. Voters in the United Kingdom also delivered a thumping rejection of the EU and in turn Bilderberg with the success of Nigel Farage and UKIP, a Euroskeptic triumph some are labeling the "most extraordinary" election result for 100 years. As well as TTIP and the fallout from the European election disaster, Bilderberg will be tackling a number of other key issues, most of which will revolve around the continued effort to centralize economic power under several different guises, including a carbon tax paid directly to the United Nations, with the financial hit being taken by individuals as big companies are granted special "waivers" that will allow them to continue to pollute. The rumbling crisis in Ukraine and the relationship between Russia and NATO will also be a focal point of Bilderberg 2014. Globalists now consider Vladimir Putin to have ostracized Russia from the new world order because he dared to "challenge the international system," as John Kerry put it. When we aren’t planting trees, other activities have been trekking in the jungle, teaching english to school children, visiting local village communities and learning about Indonesian culture. Most of all taking a well deserved break away from the stress of London life. I’ve had the trip of a life time, and tomorrow I'm going on an Orangutang boat tour for 4 days before heading to China.
