What is CROSS-BORDER INJUNCTION? What does CROSS-BORDER INJUNCTION mean? CROSS-BORDER INJUNCTION meaning - CROSS-BORDER INJUNCTION definition - CROSS-BORDER INJUNCTION explanation. Source: Wikipedia.org article, adapted under https://creativecommons.org/licenses/by-sa/3.0/ license. SUBSCRIBE to our Google Earth flights channel - https://www.youtube.com/channel/UC6UuCPh7GrXznZi0Hz2YQnQ In European Union law, and especially in European intellectual property law, a cross-border injunction is an injunction by a court in one European country, such as for example a court in the Netherlands forbidding infringement in several other European countries. The Brussels Regime instruments are a set of similar legal instruments, based on which jurisdiction (and recognition) is determined. The instruments are the Brussels I Regulations (44/2001 and 1215/2012), Lugano Conventions (1998, 2007) and the Brussels Convention (1968). The conventions together cover the European Union, Iceland, Norway, Switzerland, Aruba and all French territories. A legal basis for cross-border injunctions may amongst others be found in Article 6(1) (most instruments) or Article 8(1) (EU regulation 1215/2012), providing that "a person domiciled in a Member State to also be sued where he is one of a number of defendants, in the courts for the place where any one of them is domiciled, provided the claims are so closely connected that it is expedient to hear and determine them together to avoid the risk of irreconcilable judgments resulting from separate proceedings". For a period in the late-1990s, national courts issued cross-border injunctions covering all Brussels regime jurisdictions, but this has been limited by the European Court of Justice (ECJ). In two cases in July 2006, interpreting Articles 6(1) and 16(4) of the Brussels Convention, the ECJ held that European patents are national rights that must be enforced nationally, that it was "unavoidable" that infringements of the same European patent have to be litigated in each relevant national court, even if the lawsuit is against the same group of companies, and that cross-border injunctions are not available. In particular, the court set forth in grounds 41 of case C-539/03 that "Article 6(1) of the Brussels Convention ... does not apply in European patent infringement proceedings involving a number of companies established in various Contracting States in respect of acts committed in one or more of those States even where those companies, which belong to the same group, may have acted in an identical or similar manner in accordance with a common policy elaborated by one of them". In other words, there will be no close connection between claims as required by Article 6.1 if two closely connected companies domiciled in different Contracting States act (infringe) in the same manner. Also in 2006, the ECJ decided on case C-04/03 (GAT/LUK). The court ruled that "Article 16(4) of the Convention … is to be interpreted as meaning that the rule of exclusive jurisdiction laid down therein concerns all proceedings relating to the registration or validity of a patent, irrespective of whether the issue is raised by way of an action or a plea in objection". As of 2015, Article 16(4) of the Convention corresponds to Article 24(4) of EU regulation 1215/2012. The ruling in case C-04/03 confirms that the courts of each Contracting State have exclusive jurisdiction on validity of patents registered for the territory of that State. Exclusive jurisdiction under Article 22(4) applies irrespective of whether a patent proprietor is sued for revocation or whether an alleged infringer asserts invalidity in inter partes proceedings. In 2012, nearly six years after its rulings on cases C-04/03 and C-539/03, the ECJ decided on case C-616/10 (Solvay/Honeywell). The court held that "Article 22(4) of Regulation No 44/2001 must be interpreted as not precluding, in circumstances such as those at issue in the main proceedings, the application of Article 31 of that regulation". Since Article 31 is about provisional measures, a court may issue a cross-border injunction where an action aims for such measures. The ruling on case C-539/03 allows for a court to issue cross-border injunctions as provisional measures where companies domiciled in different Contracting States infringe in the same Contracting State.

The Nature or Natures of Agreements on Choice of Court and Choice of Law

01:08:07
To judge from judicial decisions over the last 20 years, the English common law version of private international law has come to treat agreements on choice of court as contractual agreements that will be enforced in almost exactly the same way as any other bilateral contractual agreement. This had led the courts to some conclusions, particularly in the context of remedies against breach, which look surprising as features in the landscape of private international law. But this narrow contractual focus, which takes it for granted that agreements on choice of court are promissory terms of a contract, liable to be enforced as such, has blinded lawyers to the possibility of viewing them as (multiple) unilateral notices. But Regulation (EU)1215/2012, otherwise known as the Brussels I Regulation, provides the basis for one alternative understanding of what is involved in making an agreement on choice of court. When it comes to (agreements on) choice of law, the English courts have managed to avoid having to decide whether such terms in a contract are promissory in nature. The idea that they may be non-promissory terms has yet to be worked through; but it may provide a more satisfactory basis for providing answers than the alternative, that they are promissory terms. The aim of the discussion will therefore be to consider the nature or natures of agreements on choice of court and on choice of law.

Civil Jurisdiction and Judgments 6th edition

BOOK REVIEW CIVIL JURISDICTION AND JUDGMENTS Lloyd’s Commercial Law Library Sixth Edition By Adrian Briggs Informa Law From Routledge Taylor & Francis Group ISBN: 978 1 13882 560 4 (book) 978 1 31573 630 3 (ebook) www.routledge.com/informalaw ‘WHERE DO YOU SUE?’ INFORMED COMMENTARY ON JURISDICTIONAL MATTERS WITHIN THE EU An appreciation by Phillip Taylor MBE and Elizabeth Taylor of Richmond Green Chambers Within the European Union, specifically in cross-border civil and commercial matters, what is the correct jurisdiction in which a judgment might be enforced? If this does not sound like a simple question, it isn’t -- as any practitioner in international private law could tell you -- and neither are the myriad related problems which emanate from it, any or all of which require detailed analysis and informed and authoritative commentary, which this book amply provides. Published by Informa Law from Routledge, this is the sixth edition of a long established and highly regarded work which is regarded as the foremost authority on how to enforce civil judgement specifically in the European legal landscape. Its author, Professor Adrian Briggs is the Sir Richard Gozney Fellow and Tutor at St Edmund Hall at the University of Oxford and also practices from chambers in the Temple. The focus of the book, says Briggs, is jurisdiction and ‘the enforcement of judgments in civil and commercial matters in general’. This means, he adds, that ‘the main focus of this book is on the Brussels I Regulation,’ a European instrument designated as ‘recast’ in its most recent form as Regulation 1215/2012. Adopted in 2012, the Regulation was brought into effect, after many delays, on 10 January 2015. The end result is considered by many to be rather a flawed instrument, which is why it is anticipated that the recast Regulation will be looked at again in another ten years, by which time, as Briggs hopes, there will be another edition of this book. In the meantime, the value of this new sixth edition is that it explains matters which have become unnecessarily complex. Most practitioners will remember how complicated enforcement of overseas judgements can be when they recall their days as law students, dazed, confused and bemused by the intricate aspects of a field of legal endeavour which involves multiple jurisdictions within the European Union, as well as internationally. Fortunately, this impressive work of scholarship also dwells on the practical aspects of this area of law, such as deciding where to sue… and whether the resulting judgment would be capable of being enforced elsewhere. Procedures for serving process and for objecting to jurisdiction are also dealt with --and here we cite only a few examples of the helpful insights contained in this volume, including a separate chapter on arbitration. Despite the complexity of the subject, or indeed because of it, the book has been logically organized and easy to use. There is a minutely detailed table of contents of at least twenty-four pages which makes it a lot easier to find what you’re looking for, together with four appendices and useful index at the back. There are over sixty pages of tables of cases, statutes, statutory instruments, civil procedure rules and European legislation. This book is therefore to be welcomed as a definitive work on how civil judgments are enforced internationally when you are talking about -- and involved with -- inter-jurisdictional matters. Every practitioner, particularly those specialising in international private law, should have a copy. The publication date is cited as at 10 January 2015, and that is the date when the recast Regulation, now re-numbered as 1215/2015 – and in the words of Briggs, ‘went live.’

It features multiple grand tourer race cars based on production road cars and conforming with the GT1 (2010-2011) and GT3 (2012-) regulations competing in one-hour races on multiple continents. Championships are awarded each season for drivers and teams. The FIA GT1 World Championship has started in 2010 as a successor to the previous FIA GT Championship which featured the GT1 category as well as a GT2 category. In 2012 the series originally planned to move away from exclusive use of GT1 cars by allowing 2009-spec GT2 from the former FIA GT Championship as well as current performance balanced GT3 specification cars to compete alongside the series' current GT1 cars. However as there were no interested GT2 teams and only a handful of former GT1 runners were willing to participate, the SRO decided that the 2012 season would be contested with GT3-spec cars only (yet retaining GT1 in the series' title). Sassoon on CIF and FOB Contracts

10:45
BOOK REVIEW SASSOON C.I.F. AND F.O.B. CONTRACTS British Shipping Laws Sixth Edition By Filippo Lorenzon With Yvonne Baatz for chapters 15 and 16 ISBN: 978 0 41405 844 6 Sweet & Maxwell/Thomson Reuters www.sweetandmaxwell.co.uk www.thomsonreuters.com “THE MOST IMPORTANT INSTRUMENT OF OVERSEAS TRADE”: UNRAVELLING THE COMPLEXITIES OF CIF AND FOB An appreciation by Phillip Taylor MBE and Elizabeth Taylor of Richmond Green Chambers Published by Thomson Reuters for Sweet and Maxwell, ‘Sassoon C.I.F. and F.O.B. Contracts’ has been -- since 1968 -- the stalwart voice of authority in what is widely acknowledged as an exciting, multi-faceted and undeniably complex area of shipping law. This highly regarded work has now come out in a new sixth edition as part of “British Shipping Laws”, and whilst retaining the same logical structure of the previous edition of 2012, it contains a great deal of new material reflecting the substantial changes that have taken place in this area over the last turbulent five years. This, as the author Professor Filippo Lorenzon points out, is indeed an exciting area of commercial law, noting for example, that ‘a contract of sale on CIF (cost, insurance and freight) terms (has) for the last century, constituted the most important instrument of overseas trade.’ Under a CIF arrangement, the price the buyer has to pay must include the cost of the goods, plus their insurance against risk, plus the cost of freight which carries them to their port of destination. ‘It follows’, says the author, ‘that the performance of a CIF sale has both a physical and documentary aspect which creates legal and practical difficulties.’ Fortunately for the bemused practitioner advising on such difficulties, the complexities of CIF and FOB are extensively and intensively elucidated and discussed throughout the eight-hundred or so pages of this book, which provides any number of citations from case law, together with the views of other commentators. As for the F.O.B. term, its definition is referred to as flexible and therefore adaptable to a variety of practices and circumstances. As the shape-shifting nature of such a term can cause confusion (especially if and when it overlaps with the terms of a CIF contract), it is useful that Part III of the book covers it in detail, supported by numerous references to cases. We found it useful that Part I of the book discusses the basics of CIF and FOB prior to dealing with the specifics, including the issues inherent in non-performance, for example, frustration and force majeure and remedies. The book concludes with a discussion of such matters as jurisdiction and conflict of laws. Notably the final 200 pages of the book contain fourteen appendices no less, which range from the 1889 Factors Act to the Carriage of Goods by Sea Act of 1992, to Regulation (EU) No.1215/2012 Recast. With its detailed table of contents, twenty-page index, copious footnoting, numbered paragraphs throughout and fifty pages of tables of cases, statutes and statutory instruments, this long-established and authoritative work of reference is, thankfully, easy to navigate. Commercial lawyers and certainly shipping lawyers, as well as academics, will welcome this new up-to-date edition of Sassoon as an essential acquisition for the well-stocked shipping law library. The publication date is cited as at 2017.

Me Too, Glyphosate, and ePrivacy (Tweets of the Week, Ep. 22)

03:45
"Me too" hashtag sparks harassment debate, Commission loses over glyphosate hate, and ePrivacy vote opens lobby floodgate. Kick started by the Harvey Weinstein revelations, the #metoo hashtag has gathered momentum with women from all walks of life, of course, Brussels is not immune. The Sunday Times’ Bojan Pancevski‏ and Politico’s Ryan Heath both revealed troubling allegations in the EU institutions. https://twitter.com/bopanc/status/922030689473777665 https://twitter.com/PoliticoRyan/status/923071761276694529 The issue was debated at the European Parliament, where MEPs including Terry Reintke and Sophie in’t Veld condemned a culture of silence. https://twitter.com/Stone_SkyNews/status/923120640143646720 Ciara Bottomley‏ pointed out that of the 40 speakers at the plenary debate only 5 are men. She said it was “disappointing” and “men must be part of the solution.” https://twitter.com/ciarabottomley/status/923114247617466368 James Crisp reported that on average the European Commission receives more than 1 allegation of sexual harassment every month. https://twitter.com/JamesCrisp6/status/923113341849137152 And Berlaymonster believes that it’s “too many middle aged men, too far from home for too long with too much money and too much ego.” https://twitter.com/Berlaymonster/status/923093513524441088 Cecilia Malmstrom said the #metoo testimonies are a powerful movement, a feminist outcry that women all over the world say enough! https://twitter.com/MalmstromEU/status/923106624218202112 And that’s a lot of women! The European Union Agency for Fundamental Rights  said that 55% of women surveyed across the EU have suffered sexual harassment. https://twitter.com/EURightsAgency/status/921351214473900032 Elsewhere, NGOs Friends of the Earth and Greenpeace were delighted with the latest news on glyphosate. https://twitter.com/GreenpeaceEU/status/923126852851560448 In parliament, the ENVI Committee went even further, calling for restrictions from 2018 and full ban in 2022. https://twitter.com/EP_Environment/status/922777728973180929 Belgian PM Charles Michel agreed that phasing out is necessary. https://twitter.com/CharlesMichel/status/923176541646880768 Avaaz says that 1 million EU citizens want a full ban. https://twitter.com/Avaaz/status/923124219482902528 But not everyone – many farmers were against the move with Jake Freestone saying that this is more carcinogenic and will be injested by many tonight. https://twitter.com/No1FarmerJake/status/922905683263188992 The EU Budget was also on the agenda and always attracts criticism no matter what is agreed, but stating a budget of 0.14% of GDP for EU programmes equals a European superstate is simply ridiculous said Guy Verhofstadt. https://twitter.com/GuyVerhofstadt/status/922732372109463552 But the most controversial decision is to spend €12 million in 2018 on a trial for free Interrail passes for 18-year olds. https://twitter.com/ManfredWeber/status/923167632718794752 Nathan Gill said young people don't need train tickets, they need jobs! https://twitter.com/NathanGillMEP/status/923451494682198017 But Siegfried Muresan said it will strengthen EU identity. https://twitter.com/SMuresan/status/923146304494227457 Here’s an idea, instead of putting MEPs on trains to Strasbourg every month, why not use that cash to pay for #Interrail scheme? https://twitter.com/BrusselsGeek/status/923525989946286081 Finally, approval for a Parliament mandate to negotiate the ePrivacy regulation came right down to the wire. Although approved in the LIBE committee last week. https://twitter.com/sylvieguillaume/status/921024984289546241 EPP and ECR groups tried to have the regulation opened up for more amendments. Anna Maria Corazza Bildt encouraged colleagues to reject mandate for trilogues on ePrivacy. https://twitter.com/AnnaMariaCB/status/923483675215482881 And lobbying reached fever pitch. With eagle-eyed reporter Laurens Cerulus identifying at least one troll account! https://twitter.com/laurenscerulus/status/923453033299763200 And his Mlex counterpart Magnus Franklin spotting that the EPP website statement on ePrivacy contains 12 trackers, corresponding S&D website contains one. https://twitter.com/magnusfranklin/status/921015172872966144 Even Commission VP Andrus Ansip felt he had to wade into the Twitter debate to clarify a lot of misunderstandings ePrivacy is not against media freedom he said. https://twitter.com/Ansip_EU/status/923221589679800327 But as confirmed by Ralf Bendrath, the LIBE mandate was confirmed by plenary with 318 to 280. So congratulations!

Best Mobile Phone Service for Travelers | Tips on Staying Connected While Abroad

One of the most incredible feelings is connecting with others while traveling, even when you’re half away around the world. Calling hotels, getting directions, sharing photos, and using apps are just some of the ways that having a mobile phone with connectivity can improve your travel experience. Roaming the world with your phone used to be an expensive luxury, but is quickly becoming a normal and expected feature as carriers compete for your business. As of late 2017, two mobile phone services currently have the most simple and cost effective roaming plans for US travelers, and that’s T-Mobile and Google’s Project Fi. In this video, we review the mobile phone services, as well as provide tips on using your phone while traveling abroad. --- HELPFUL LINKS: - SERVICE: T-Mobile ⇨ http://bit.ly/2zmAe2l - SERVICE: Project Fi ⇨ https://goo.gl/APQ4qw - ARTICLE: “International roaming: which carrier is best?” (WhistleOut) ⇨ https://goo.gl/ikJs2v - ARTICLE: “Best Phone for International Calls, Texts, and Data” (Million Mile Secrets) ⇨ https://goo.gl/zQ2QnC - ARTICLE: “Best International Phone Plans: What Travelers Need to Know” (Tom’s Guide) ⇨ https://goo.gl/JkmbzB --- EQUIPMENT (USED TO CREATE VIDEO): - CAMERA: Canon G7X Mark II ⇨ http://amzn.to/2rPix8h - MICROPHONE: Zoom H1 ⇨ http://amzn.to/2rgM7mi - LIGHTING: ESDDI 20"x28" Soft Box ⇨ http://amzn.to/2xiDRFb --- FOLLOW US: - Newsletter / Website ⇨ http://www.tripastute.com - Instagram ⇨ https://www.instagram.com/tripastute/ - Pinterest ⇨ https://www.pinterest.com/tripastute/ - Twitter ⇨ https://twitter.com/TripAstute - Facebook ⇨ https://www.facebook.com/TripAstute/ --- SUPPORT US (USING OUR REFERRAL LINKS): - Shop on Amazon (US) ⇨ https://www.amazon.com/?tag=tripa02-20 - Shop on Amazon (UK) ⇨ https://www.amazon.co.uk/?tag=tripa02-20 - Credit Card Offers ⇨ http://www.tripastute.com/credit-card-offers/ - Travel Insurance (via World Nomads) ⇨ http://www.tripastute.com/travel-insurance/ --- TRAVEL DISCOUNTS: - Airbnb (use ERNESTS1215 for $40 off your 1st booking) ⇨ http://bit.ly/2rjNUak - Lyft (use ERNEST243 for $10 off your 1st ride) ⇨ http://lft.to/2rjP8lX - Uber (use ERNESTS1354ue for $20 off your 1st ride) ⇨ http://ubr.to/2rB157P --- MUSIC CREDITS: - “Magic Marker” by Silent Partner - “Modus Operandi (M.O.)” by Wes Hutchinson - “Strolling Through” by Silent Partner - “Sophomore Makeout” by Silent Partner --- PHOTO CREDITS: - Pixabay ⇨ https://pixabay.com

Lawful Rebellion - Its Time To Reassert Our National Sovereignty

01:22:36
By: Rogers Hayes & The British Constitution Group Mirrored By: NAUresistance.org On the 15th June 1215 the Great Charter of Liberties ('magna carta communium libertatum Angliae') was agreed between King John and the rebellious Barons of England. This Charter effectively ratified the supreme constitutional principles of: firstly, that the State exercised governance only with the full consent of those it governed; secondly, the right of the governed to invoke lawful rebellion was conceded formally by the State; and thirdly, that these fundamental rights extended for all time to us all (the 'communa tocius terre'). The Great Charter, codified by us, the people, gave the principles upon which the Resistance may be pursued. Article 61 of the Charter provides for the action of lawful rebellion. It refers to "communa tocius terre" (all the people of the land) - and does so in terms of Article 1 of the document, with specific reference to "all freemen of the realm". This Charter is still Law. It has not been repealed since it is not within the power of Parliament to set aside agreements between the people and the Monarchy. Our present system of government (of Parliament) is the consequence of this ancient and exemplary act of lawful rebellion. Parliament cannot therefore undo or deny to us our Customs and Constitution without committing the ultimate act of treason and betrayal. Not only must The Great Treason be opposed and stopped - it must also be undone. The United Kingdom Government has, over the last one hundred years, conspired to become a treasonous assembly and Parliamentary dictatorship. Parliament has acted with malice towards the English. It makes unlawful Statute for the purpose of giving life to its treason -- and to suppress dissent. The members of this wretched assembly are oath breakers. Parliament has betrayed those English people who have given their lives to defend this sovereign nation. This is The Great Treason. As members of 'a people' -- of the descendents of the first people of this Island -- we have a natural entitlement to self-determination. And, as descendents of those that gave us, a free people, our Constitution and Law, we have also an irrevocable right to declare lawful rebellion against a malevolent and authoritarian State. The State must be answerable to the people or suffer the consequences as a treasonous assembly. The Magna Carta is unambiguously a Charter for the freedom of the people. Clearly it does not provide a warrant for anyone resident here to engage in rebellion (Magna Carta, Article 51). It does not extend to the treasoners (obviously), nor to the treasoners' collaborationists and auxiliaries. The right of self-determination -- of the native entitlement of the people of Britain -- is reflected in Constitutional Law. And not just in Magna Carta. For example, the Act of Settlement 1700 (section 3) states: That after the said limitation [of succession] shall take effect as aforesaid no person born out of the kingdoms of England Scotland or Ireland or the dominions thereunto belonging (although he be made a denizen) (except such as are born of English parents) shall be capable to be of the privy council or a member of either House of Parliament or to enjoy any office or place of trust either civil or military or to have any grant of land tenements or heriditaments from the Crown to himself or to any other or others in trust to him. This is still Law. The objective of the Lawful Rebellion is therefore to end the Great Treason; to bring the treasoners to account; and to undo the harm done to us by those people. Lawful Rebellion has the authority of native entitlement; of precedent set in ancient Constitutional agreement; of Natural Law; and of a powerful moral argument. Lawful Rebellion is an act of lawful resistance against an unlawful and treasonous State. Lawful Rebellion is not a single act... it is a process. It has many facets and comprises the bringing together of people of like-mind who seek to reassert our national sovereignty whether as individuals or in groups under the single and recognised umbrella of 'lawful rebellion' so that a variety of actions may be taken that will eventually lead to the unequivocal recognition of our constitution and the acknowledgement of the reassertion of our national sovereignty - in defiance of those who have worked to destroy it. How to Set the Time for the Rolex GMT-Master II

02:07
Watch Chest presents a quick how-to video on how to set the Rolex GMT-Master II. You will learn the GMT-Master II's anatomy and crown positions, as well as find out how to set the time, date, and manually wind the movement. How To: Set the Rolex GMT-Master II (Transcript) To set your GMT-Master II, we have the Hour Hand, Minute Hand, Second Hand, 24-Hour Hand, Date Window, 24-Hour Graduated Bidirectional Rotatable Bezel, and finally the winding crown. The winding crown has 4 positions, numbered from 0 to 3. Position 0 is fully closed and where the crown should be at all times if you are not setting your watch. Position 1 allows you to manually wind the movement; position 2 sets the hour and date; and position 3 sets the minute and your choice of a 2nd time zone with the 24-hour hand. First, unscrew the crown by rotating counterclockwise, where it will naturally pop out into position 1. We find it easiest to set the GMT by starting out in Position 3. Gently pull the crown all the way and the second hand will stop moving. As you set the minute, the 24-hour hand will move and the date will advance as you pass over midnight. Use the 24-hour bezel to set the second time zone. In this case, I will be setting it at 1600, or 4 pm in 12-hour time. You can now set the minute. Now push the crown into position 2. Here you can quick-set the date by moving the hour hand. Pushing the crown back into position 1, wind the crown 20 rotations to give the movement a manual charge; something you will need to do whenever you set the time or at least once a month for maintenance. Make sure the winding crown in fully screwed closed; pushing it towards the case as you rotate it clockwise to ensure water-proofness.

The Rule of Law: perspectives from around the Globe

01:11
An appreciation by Phillip Taylor MBE and Elizabeth Taylor of Richmond Green Chambers. A RULING ON OUR LAWS. The rule of law, as Francis Neate explains, has emerged prominently into public discussion and although it defies a precise definition, its of special interest to lawyers, and one to which they should perhaps pay more attention, he suggests. As General Editor, Neates 270 page work in 27 chapters is a compilation of academic papers on the rule of law. These papers were delivered primarily at one of several international symposia by a number of distinguished contributors ranging from Lord Bingham and Lord Goldsmith to Valery Zorkin, the first and current Chairman of the Constitutional Court of the Russian Federation. Other contributors include Mary Robinson, the former Irish President and Justice Albie Sachs, anti-apartheid campaigner appointed by Nelson Mandela in 1994 to serve on South Africas Constitutional Court. Just reading their brief biographies in the introductory sections of this volume is an interesting exercise in itself to research our concept of the rule of law. The symposia were convened under the auspices of the International Bar Association (IBA) which has been at the forefront promulgating interest in and insights into, the rule of law worldwide. Basically the rule of law refers to a system of law binding on all -- even kings -- and acts as a restraint on the powers of the mighty. The laws of Moses are a good example. It encompasses two fundamental principles, namely that those in power should not make the laws and all people (including those in power) should be bound by the laws. The Rule of Law, said Aristotle in The Politics is preferable to that of any individual. Since Aristotle -- and Socrates and Plato a century before him -- the quest for justice under the law has been a recurrent one. The epic struggle to establish and apply the principles of the rule of law has taken place over more than two millennia. The struggle, which still continues, has been advanced by certain pivotal events like Magna Carta in 1215, the Putney debates at the end of the English Civil war and the American Revolution, which as Neate says: represented a major turning point in the history of the relationship between government and the governed. Dipping into the content of the book, one discovers any number of interesting gems. For example, check out the chilling reminder of how Hitler circumvented and abused the Rule of Law in Nazi Germany by the simple expedient of the Enabling Act, which was passed without the required two-thirds majority. Communist members, having been arrested, were prevented from voting. Remaining representatives were reminded of the persuasive power of the storm troopers. The Enabling Act, as a device, meant that Hitler could enact legislation without Parliamentary ratification and therefore without any checks on his legislative power, which in these turbulent and unsettling times begins to sound vaguely familiar especially the bit about parliamentarians being arrested. How much legislation has been enacted in the UK during the last decade without parliamentary debate and almost unnoticed by the press or public? One can always dream up excuses for this disquieting situation, the most oft repeated being that debating various measures in parliament is so, well, tedious and time wasting. How easily are hard won liberties eroded in the name of efficiency. With its global and historical perspectives, Neates editorship of The Rule of Law is certainly a riveting read and offers authoritative and fantastically useful background to practitioners, students and casual readers alike who wish to delve further into this fascinating and suddenly very topical subject which we will have another electoral ruling on soon. EU red tape 'BURDEN' is costing businesses - but Brexit will FINALLY change all that Mike Cherry, the National Chairman of the Federation for Small Business outlined exactly what UK companies want from the final Brexit deal. Mr Cherry also revealed what small businesses in Britain are looking forward to once the UK has cut ties with the European Union. Speaking exclusively to Express.co.uk, Mr Cherry said: “We always get asked the question about individual bits of regulation.“Of course, it is not necessarily the regulation per se, the important thing to recognise is that it is often the accumulative burden of regulation in the amount of time it takes the business owner or mana... BREXIT THREAT: Brussels set to strip UK airlines of safety certificates in no deal Brexit Brussels has been busy sending out warnings to stakeholders across key European industries, telling them to be prepared for the effects of a no deal Brexit. If Brussels and Westminster fail to come to an agreement on aviation, British airlines and aircraft manufacturers will no longer be covered by EASA’s safety certification. EASA issue permits to fly, airworthiness certificates, approve maintenance organisations and also handle licensing across EU countries as well as the EFTA countries – Iceland, Liechtenstein, Norway and Switzerland. In the Brussels-issued warning, it says EASA would no longer allow British “persons or organisations” certificated to its standards. Alex Jones of Infowars / PrisonPlanet interviews Godfrey Bloom MEP of UKIP 4/5

08:31
28th December 2009 PrisonPlanet.tv Alex Jones of Infowars / PrisonPlanet interviews Godfrey Bloom MEP of UKIP, Member of the European Parliament for Yorkshire and the Humber. Alongside his involvement with, and the history and evolution of, the United Kingdom Independence Party, they discuss the false choice of the two main parties in the US and UK provided to the electorate regarding the ceding of sovereignty to supranational organisations, the EU and UN, and in providing no voice for critics of the AGW (anthropogenic global warming) hypothesis, the declared consensus, which in the light of ClimateGate and popular division is a clear failure of the LibLabCon to provide adequate democratic representation. Bloom raises the "sovietisation" of Europe through the development of the Common Market into the European Union, where legislation and policy is initiated by an unelected and unaccountable EU beaurocracy, how this process clearly violates the codified aspects of the UK Constitution and how the continuing implementation and extention of the doctrine of Corpus Juris, the Napoleonic Code, which restricts rights of habeus corpus and trial by jury, is clearly in direct conflict with our rights as British Citizens, established by Magna Carta 1215, The Bill/Declaration of Rights 1688 and the founding principles of our Parliament. The demand of UKIP for there to be a binding referendum in the UK on EU membership is again reiterated, the people of the UK having never consented to political harmonisation, union or (further) integration with Europe. The arguments against state-run socialised healthcare, including rationing, impersonal care and the lack of medical privacy are well-covered in the context of the Senate healthcare bill. This is the second UKIP MEP to be interviewed by Alex Jones and represents a significant development in the association between the US and UK movements for national sovereignty and respect for the hard-won, constitutionally entrenched, rights of the individual and restraints upon the lawful power of the State; sovereignty resides with the People, any and all legal authority of Government exists by and only "with the consent of the Governed."

The FIA GT1 World Championship is a world championship sports car racing series developed by the SRO Group and regulated by the Fédération Internationale de l'Automobile (FIA). All vehices will be performance balanced with weight and restrictor adjustments to make different makes artificially more equal. John Guinn Travel Show - 8th December 2016 (part 2 of 5)

Source: https://www.spreaker.com/user/travel_researcher/john-guinn-travel-show-8th-december-2016 International Day of Persons with Disabilities was held on 3rd December. The consumer advice organisation the UK European Consumer Centre (UK ECC), which is part of the European Consumer Centres Network - ECC-Net, used the occasion to draw attention to the rights and problems of air passengers with disabilities or reduced mobility. My first guest is Adam Mortimer, from UK ECC, and he talks about the EU regulation 1107/2006 which identifies rights of disabled persons and persons with reduced mobility when travelling by air. My local airport is London Luton and it works in partnership with the Bedfordshire Disability Resource Centre (DRC) to ensure that passengers who require assistance are able to get around the airport and on/off the planes. My second guest is Simon Daize. Simon is the Partnership Liaison Officer for DRC and the Northamptonshire Centre for Independent Living (CIL). Simon talks about his own experience of flying, the partnership with Luton Airport and how proactive it is in planning facilities for all passengers. I've mentioned EU261 many times on the show, but did you know that there is a similar regulation for those travelling over water. Adam from UK ECC also gives us the lowdown on the rights of passengers travelling by sea and inland waterways, EU 1177/2010. There are regulations for passenger rights on most forms of transport, UK ECC has an app that explains all and is worth having on your smart phone. Travel news includes Ryanair Holidays, Christmas Markets in Hamburg and how Airbnb is working with authorities in London and Amsterdam to ensure the vacation rental market doesn't reduce housing for locals.

Bilderberg Agenda Revealed: Elite Desperate to Rescue Unipolar World Anti-EU revolution, Ukraine crisis threaten to derail global government By Paul Joseph Watson - Global Research, May 28, 2014 - Infowars 27 May 2014 The 2014 Bilderberg meeting in Copenhagen, Denmark is taking place amidst a climate of panic for many of the 120 globalists set to attend the secretive confab, with Russia's intransigence on the crisis in Ukraine and the anti-EU revolution sweeping Europe posing a serious threat to the unipolar world order Bilderberg spent over 60 years helping to build. Inside sources confirm to Infowars that the elite conference, which will take place from Thursday onwards at the five star Marriott Hotel, will center around how to derail a global political awakening that threatens to hinder Bilderberg's long standing agenda to centralize power into a one world political federation, a goal set to be advanced with the passage of the Transatlantic Trade and Investment Partnership (TTIP), which will undoubtedly be a central topic of discussion at this year's meeting. The TTIP represents an integral component of Bilderberg's attempt to rescue the unipolar world by creating a "world company," initially a free trade area, which would connect the United States with Europe. Just as the European Union started as a mere free trade area and was eventually transformed into a political federation which controls upwards of 50 per cent of its member states' laws and regulations with total contempt for national sovereignty and democracy, TTIP is designed to accomplish the same goal, only on a bigger scale. The deal is being spearheaded by Obama's U.S. Trade Representative Michael Froman, a Wall Street insider and a CFR member, Bilderberg's sister organization. Froman is simultaneously helping to build another block of this global government, the Trans-Pacific Partnership, which is a similar project involving Asian countries. Given that Bilderberg schemed to create the Euro single currency as far back as 1955 (Bilderberg chairman Étienne Davignon bragged about how the Euro single currency was a brainchild of the Bilderberg in 2009 interview), the results of the European elections are sure to have stirred outright alarm amongst Bilderberg globalists who are aghast that their planned EU superstate is being eroded as a result of a populist resistance mainly centered around animosity towards uncontrolled immigration policies. In Denmark itself, the buzz is centered around Morten Messerschmidt and the Danish People's party, which won 27% of the vote in the Euro elections and doubled its number of MEPs. Although some are wary of Messerschmidt's far right inclinations, his success reflects a general resentment not only in Denmark but across Europe towards immigration and the welfare state, concerns that the EU has only exasperated. Meanwhile in France, Marine Le Pen is carving out a role as the face of a conservative movement that threatens "to break up one united Europe," with her European election win being described as an "earthquake" that has rattled the political heart of Europe. Voters in the United Kingdom also delivered a thumping rejection of the EU and in turn Bilderberg with the success of Nigel Farage and UKIP, a Euroskeptic triumph some are labeling the "most extraordinary" election result for 100 years. As well as TTIP and the fallout from the European election disaster, Bilderberg will be tackling a number of other key issues, most of which will revolve around the continued effort to centralize economic power under several different guises, including a carbon tax paid directly to the United Nations, with the financial hit being taken by individuals as big companies are granted special "waivers" that will allow them to continue to pollute. The rumbling crisis in Ukraine and the relationship between Russia and NATO will also be a focal point of Bilderberg 2014. Globalists now consider Vladimir Putin to have ostracized Russia from the new world order because he dared to "challenge the international system," as John Kerry put it. Bilderberg will discuss fears that Putin is intent on constructing an alternative world order based around the BRICS countries, a "multi-polar" system that would devastate the dollar as the world reserve currency and also heavily dilute the current US-EU-NATO power axis. Infowars reporters will be on the ground all this week to cover the 2014 Bilderberg Group conference in Copenhagen, Denmark. Paul Joseph Watson is the editor at large of Infowars.com and Prison Planet.com. http://www.globalresearch.ca/bilderberg-agenda-revealed-elite-desperate-to-rescue-unipolar-world/5384291

Cal Dooley Testimony Before House Ways and Means Committee 9-22-11

05:23
"I appreciate the opportunity to testify on behalf of the American Chemistry Council and our members and to offer my thoughts on the importance of a stable, competitive natural gas market to meet future energy demand and ensure America's economic competitiveness. "Your hearing today acknowledges that the United States tax code is often used to drive energy policy and influence markets -- and sometimes, with unintended and detrimental results. The ACC believes that our nation needs a comprehensive energy strategy that promotes the sustainable, efficient use of all energy sources, not a piecemeal approach that relies too heavily on the tax code to promote specific market outcomes. "The New Alternative Transportation to Give Americans Solutions Act ("NAT GAS" Act) is one such ineffective, inefficient proposal, offered at a time when our nation can least afford it. If enacted, subsidies like those in the NAT GAS Act will distort the natural gas market by artificially increasing demand ahead of supply, and will risk stifling investment and job creation."
