Brahm Siegel, a specialist in family law and partner of Nathens, Siegel LLP answers: How is property divided between two spouses in a divorce in Ontario? A lot of people think, erroneously, that the way we deal with property in Ontario is by just dividing everything equally. That’s absolutely not true and any lawyer who tells you that is a lawyer to stay away from. We don’t take the RRSP or the pension and chop them in half to give 50% to each side. Obviously, if something is in joint names and owned by the parties as joint tenants, each is entitled to half – but that’s not how it works for all property. So, how does property work? Every province has its own rules, but in Ontario, we have something called “equalization.” Equalization is a fancy legal term for a monetary payment that one spouse pays to the other to make life equal. A good way to think about it is that we must take a picture of two different times in the parties’ lives: the date of the marriage and the date of the separation. The law says that we have to take a picture, so to speak, of what each person’s net worth was – net worth meaning assets minus liabilities. We do this both at the date of marriage and the date of separation, which is also called “the valuation date.” We do it for both parties, because the law says you have to look at the increase in the net worth of each party from marriage to separation. If both parties wind up increasing their net worth by the same amount of money from marriage to separation (it goes by increase in dollars, not by percentages), then neither of them owe anything to the other. Anything either of them has individually stays with that person; if there are any individual debts, they stay with that person. Cases in which both parties increase the same amount from marriage to separation are pretty easy. Most cases, however, are not so simple. Usually, one person has increased more than the other – either because they have assets that their spouse doesn’t have or they have the same amount of assets but their spouse has more debt. The law says that marriage is a partnership, and so any increase that one party has over the other has to be shared. The way it’s shared is by one person paying the other a chunk of money – which can be paid by writing a cheque, or rolling over from one spouse’s RRSP to the other spouse’s RRSP, or transferring their interest in the marital home to the other spouse. Let me leave you with two other concepts related to equalization: deductions and exclusions. Deductions are things that people own at the date of marriage. As I said, we look at the increase in your net worth from marriage to separation, so if you come into the marriage worth something, that value is deducted from what you own at separation and, therefore, it’s called deduction. It can be anything from a car to an RRSP to a house that you owned at the date of marriage (however, if the house that you owned at the date of marriage is the same house you have at separation, and it’s the matrimonial home, you may not get to deduct the pre-marriage value – but that’s for another discussion). Exclusions are things that we include at the date of separation, but which then get factored out. At the end of the day, they make no difference to the bottom line – they make no difference to an equalization payment. The law has listed a few of these and determined that they should not be shared with the other spouse through equalization. Exclusions are things like life insurance proceeds, gifts a party received from a third person during the marriage (not from the other spouse), or an inheritance or the part of an inheritance that you can trace. If you have, for example, inherited $5,000 during the marriage and you used it to buy a piece of art that’s worth $10,000 at the date of separation, then the value of the art gets excluded for purposes of equalization. Here’s an example of how equalization works in practice. Let’s take a couple – John and Jane – and say that John has increased his net worth by a $100,000. (Note: he could have been worth zero at marriage and increased to $100,000 at separation, or at marriage he could have been worth $1,000,000 and increased to $1,100,000 – the key is the growth, which is $100,000 in this example.) Let’s say Jane increases her net worth by $80,000. The difference between them is $20,000 – but that doesn’t mean the equalization payment is $20,000. The equalization payment, if you haven’t figured it out already, is half: $10,000, which would bring John down to $90,000 and bring Jane up to $90,000. Nine states are currently community property states: Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington, and Wisconsin. Community property is a state statute mandated concurrent form of ownership between H and W. Earnings of the H and W are considered CP and thus are equally divided between the spouses during marriage. Assets bought by one spouse during marriage with CP funds earned during marriage are CP. Separate property (SP) of each spouse brought into a CP state remains SP, as long as SP is properly segregated (not commingled) and thus separately identifiable. Income from SP is SP income. CP state (See California Fam. Code §125), may treat property acquired during marriage in a common law state as CP for CA marital property division purposes if it would have been CP had it been acquired in a CP state. SP in a CP state may include property owned before marriage and property acquired during the marriage with solely the proceeds from the sale of SP. Each spouse may inherit or receive by gift property that will be classified as SP at divorce if not commingled and thus separately identifiable. Watch for SP assets improved with CP funds or labor which may result in an allocation of CP value to the marital balance sheet Business owned before marriage Labor of a spouse that improves value of business during marriage is a CP asset. If a business predates the marriage, it will likely be due a SP allocation and CP allocation. The SP and CP allocations depends on several factors. The SP and CP allocations depends on several factors. Example of Factors Considered: How long before the marriage was the business started? What was the FMV and profitability of the business before marriage? What was the business’ average cash flow before and after marriage? Example of Factors Considered: How much of the value change during the marriage resulted from the CP efforts of SP owner spouse? How much SP money was invested into it during the marriage? How much CP money was invested during the marriage? What were market conditions at marriage and at time of divorce? Community property (CP) law may never the less be relevant to common law states where property is acquired in a CP state and subsequently brought into a non CP State because may remain CP for common law state and tax purposes.

I'm a divorce and family law attorney here in San Diego, California. This is one of a series of informational videos aimed at addressing common issues that come up in California divorce and family law cases. Today I'll be talking about how California views the division of community property and community debts. And to get started I want to kind of explain what a community is. The way California courts look at the division of property is they look at the marital community. The marital community is established the day you get married, and it ends on the day that you separate. What California law says is that everything that was acquired by you and your spouse between the date of your marriage and the date of your separation is considered community property with the exception of a couple of things. Inheritances to either you or your spouse, gifts to either you or your spouse from family members, and then accumulation on separate property that you brought into the marriage. For example if you owned a house prior to coming into the marriage and you kept that house as your own separate property and rented it out, those rents would be your own separate property, and they wouldn't be considered to be community property. And they might be considered to be income to the community, but not necessarily community property. So when you get served with a Petition for Dissolution or you file your own Petition for Dissolution, you need to have a good understanding with respect to what the courts are going to consider to be community property, because that's what you're going to be dividing. Now it's a good idea when you're entering into a divorce to have kind of a plan with respect to what you would like to get out of the divorce. Are there pieces of property that you're willing to give up in negotiation? Are there pieces of property that are deal breakers for you that you need to have? Do you own a house? What are you going to do with that house? I would say as far as divorces are concerned, especially with the state of the economy, if a couple owned a house together that's probably one of the hardest issues to deal with. These days we have houses that are upside down, and so the house becomes, you know ten or fifteen years ago house was an asset to be divided, and you divided the equity; now a house is more of a liability. And so you need to decide whether or not you're going to short sell the house, whether one party's going to assume the house which is a liability, whether or not you're willing to accept that liability. One of the hardest parts of assuming a house that's upside down in a divorce is that your spouse that doesn't want the house isn't going to want to be on the loan any longer. And so you're going to have to find a way to either refinance the house, or the two of you are just going to have to decide to sell the house. Now that's one big issue when it comes to community property. The other big issue is the debt. Like I said before all of the debt acquired by the couple from the date of marriage to the date of separation is considered to be community debt. What California law says is that debt should be split in half. And there's a couple of exceptions to that. One exception would be student loan debt. So if you're married, say you're married for ten years, and you go and you get a college education, you take out student loans, well those student loans are going to be separate property. However the credit cards are going to be split up regardless of whose name the credit card is in. So ask yourself if your spouse had credit card that you don't know about, and your spouse has been spending money that you know you don't know about. You have to find out, because you're going to be responsible for one half of that debt. The most important thing that I always tell my clients is that you need to try to settle the case with respect to division of property. Like I said before, go into the divorce with a game plan, have your bottom line, talk to your spouse about what you would like to keep and what you're ok giving up, and try to make that division as equitable and as equal as possible. Parker Herring discusses equitable distribution, the division of assets, property and debts during a divorce. TRANSCRIPT: Equitable distribution is the division of property through the court system. And you can do equitable distribution without involving the court and end up with a separation agreement or collaborative law. But it’s the division of all of your property. What is property? It’s the stuff, it’s the things. So you start with real estate, then you go down to what I call paper money accounts, retirement accounts, vehicles, airplanes, motorcycles. And then you look at your debt, and then you have the things in your house. And you try to figure out a way to value all of those items, to classify whether they’re marital or separate, and then after you’ve valued them, to divide them. It’s called “equitable distribution” because in North Carolina, there is a presumption that “equal” is “equitable,” but there are factors which a court can decide, or parties can decide between them, that they don’t want to exactly do a 50-50 split. Although if you do go to court, and have a judge make the decision, equitable distribution is going to result in the parties having an equal division, unless one of the 13 factors is recognized by the judge as compelling. When you sign a separation agreement, and it includes property settlement, then it’s standard form to state that the court is not going to get involved, so you have divided the property by yourselves without the court getting involved, so there will be no equitable distribution process with the court. And it’s a cumbersome process. You each have to file a complaint, answer a complaint, file an affidavit, which has all of the issues before you, and where you each state whether you feel the property is marital or separate, and what you feel it’s worth. And then you do spreadsheets, and you have pre-trials. So the court process of equitable distribution is very time-consuming. It’s very important to not file for an absolute divorce, or not let your spouse obtain an absolute divorce, without preserving the rights to have the court decide spousal support and division of property. If your spouse files a complaint, and it doesn’t include division of property, and you don’t answer and make a claim for division of property, then you’ve lost the right to have the court decide that. And then the property will be divided basically by title.

How is property divided in a Seattle divorce and what can you do to assure that everything is properly accounted for and you get your "fair share" so to speak? You need to begin by creating a Divorce Spreadsheet, and listing all of your marital assets as well as anything that can be classified as a separate asset - in other words, did either party own something of value prior to getting married that was not purchased with community money. Did you husband or you own a car previous to marriage? That would be a potential example of separate property. On your spreadsheet, we need to account for the asset, whether commmunity property or separate property, define the value of that asset and then define any debt on that asset in order to arrive at the net value of your assets. So this means if you own a home together, you are going to need to get it appraised. If you have cars, you need to determine their value by going to a source like Kelly's Bluebook. How about savings accouts, checking accouts and the value of any retirement plans held by either party? We need to account for those assets also. Is there a business involved, how about business assets, valuation of business, cash on hand and in the bank, etc. This information needs to go on your divorce spreadsheet. Now how about unsecured debt? Do you have credit cards and balances owing, all of this is taken into consideration when you get to court. It is critically important you have as accurate a picture as possible for your finances as the courts will use this information. The Seattle Divorce courts will use this information in making their determinations in your Seattle Divorce. In Washington, all property generated by the two parties during the years they were a couple is generally considered community property (or marital property) and is up for division. This includes retirement account benefits. The law in Washington (and thus in your Seattle Divorce case) starts with an assumption that community property will be split 50-50. However, from there the court will consider a variety of factors that could lead to different percentages. For example, when one party is the higher wage earner, the courts may attempt to put the parties in a closer economic position after the divorce through property division and spousal maintenance. Fifty/fifty is just the starting point. There are various legal factors that can tip a property distribution in favor of one spouse. You had better be sure you have an attorney who has enough experience in the courtroom to know how judges are viewing property distribution, so you can get the best possible result in your Seattle divorce.
